Relocation of rice milles from Abakaliki Was Opposed By The Court. The Enugu Division of The National Industrial Court (NIC) has ordered The Ebonyi State Government to stop its planned Relocation of millers in The popular Abakaliki rice Mill.

The Court asked The government to refrain from ejecting, interfering with and/or mandating The Abakaliki rice Millers to relocate from their land and registered office/place of business at N0.1 rice Mill Industrial Area, Abakaliki.

Ruling on motion exparte brought by Mr. Pius Akpogwu, Vice-Chairman of rice Mill Owners Association, against The Government of Ebonyi State and eight others, The court, presided over by Justice A. Ibrahim, ordered The parties to refrain from taking any steps that would lead to break down of law and order, pending The hearing and determination of The motion on notice.

Ebonyi State Government, it will be recalled, had three months ago given The rice millers up till May 31, 2012 to relocate to any of The three rice mill clusters established by The government at Iboko in Izzi, Onuigboji in Ikwo and Osso Edda in Afikpo South local government areas.

The Court ordered that The status quo be maintained even as it instructed that The originating processes as well as The motion on notice and The hearing notice be issued and served on The defendants with proof of such service kept in The case file before The next adjourned date.

The applicant in The matter is rice Mill Company (Nig) Ltd, while The respondents include; The Ebonyi State Government, The governor of The state, The Attorney-General and Commissioner for Justice as well as Commissioner for Commerce and Industry.

A copy of The Court order signed by The Registrar and dated May30, 2012 Was made available to journalists yesterday in Abakaliki.

The Court noted that The order Was given upon reading The claimant’s motion exparte brought pursuant to Section 6 (6) 35, 36, 43, and 44 of The 1999 constitution of The Federal Republic of Nigeria as amended, Section 28 and 44 of The Land Use Act 1978, Section 401, of The Companies and Allied Matters Act 2004 and Order 7 Rule1 (1), (2), (3).

It Was also made in line with Order 11 Rule 2 and 8, Order 14 Rule 1 (1), (2), (3) of National Industrial Court Rules, 2007 and under The Inheritance Jurisdiction of The Honourable Court and after hearing Leonard Igboke Esq, counsel for The claimant.

The matter Was adjourned to The 13th day of June, 2012 for hearing of The motion on notice.

In a reaction, The state Attorney General and Commissioner for Justice, Dr. Ben Igwenyi, said The state Was yet to be served with any order or Court processes, and that The Court has no jurisdiction to entertain such matter.
