NJC: Will Salami be reinstated by Jonathan?

The National Judicial Council, NJC’s, recommendation, yesterday, that embattled President Court of Appeal, Justice Ayo Isa Salami, be reinstated is quite instructive legally and morally. Earlier, the decision on whether or not to reinstate him had divided the nation’s highest judicial advisory body.

With this recommendation, the onus is now on President Goodluck Jonathan to do what is expected, considering the haste with which Salami’s replacement was announced when the NJC ordered his suspension from office.

For Justice Salami, the NJC’s long awaited recommendation is a twin victory morally and legally. As a senior judicial officer who had sworn to do justice in all matters before him, he refused to compromise even at the risk of his career. Salami believes in the sanctity of justice and he upholds it.

Legally, rather than buckle and apologise as he was ordered to do by the committee that investigated the stand-off between him and ex-CJN Aloysius Katsina Alu, he headed for the court.

Though the matter did not go the whole hog in the courts, many, however, believed Salami had a good case.

The Salami versus Katsina-Alu face-off began over the 2007 Sokoto State governorship election petition. The PCA had alleged undue interference in the outcome of the petition between All Nigeria’s Peoples Party, ANPP, and Peoples Democratic Party, PDP, candidates.

What followed was an unprecedented crisis that convulsed public confidence in the integrity of nation’s judiciary. It was in the heat of the crisis that the former CJN bowed out of office, leaving behind a judiciary with a tarred imaged.

Incidentally, the current CJN Justice Dahiru Musdapher, who curiously was a party to the suit Salami filed against NJC had come to the rescue when he set up a panel to review the matter.

The CJN’s panel found no wrongdoing against Salami, hence it recommended his reinstatement.

Now that the NJC has spoken, it remains to be seen whether President Jonathan Will heed the advice. This, to many observers, is the only path of honour to follow.
