افتراضي Servicom Ex-chief Sues MTN Over Alleged Contract Breach

FORMER National Coordinator of Service Compact (SERVICOM) and Senior Special Assistant for Special Duties (International) to erstwhile President Olusegun Obasanjo, Alechenu Ad’Obe Obe, has taken MTN Nigeria Limited to the High Court of the Federal Capital Territory for a Breach of contract.

In the suit filed by his lawyer, Kanu Godwin Agabi (SAN), Obe is seeking a declaration of the court that the defendant’s disruption and blockage of his mobile telephone line constitutes a gross Breach of Contract between him and MTN under which the defendant undertook to grant mobile telephone services to him.

He also wants a declaration that the disruption of his mobile telephone services by the defendant has occasioned serious economic and financial losses/damages to the plaintiff.

The plaintiff therefore wants an order of court directing the defendants to pay to the plaintiff N100 million as damages for loss of business arising from the said disruption of the plaintiff’s mobile telephone services as well as an order directing the defendant to forthwith close the account and forthwith refund to the plaintiff all unspent money in the plaintiff’s account.

According to the statement of claims, the plaintiff, who is also an international writer, journalist and publisher had entered into a Contract with the defendant for post-paid customer service in May 2002 with post-paid account number 1157569.

The plaintiff also stated that as a high net-worth customer with an impressive global network with N140,000 credit limit per month, he had Over two thousand contacts, and gathered great mileage in communication, both local and international, while the agreement subsisted.

According to him, his telephone line with the number 08034080642 was the only means by which he communicated with his friends, family and business associates during this period.

Obe said that in January 2011, even though he was not indebted to the defendant and had fulfilled other obligations under the contract, he suffered continual disruption of services on his line, including blockage, without any justifiable reason.

The disruption or blockage of his communication, the plaintiff said, began with disruption to the roaming service for which he paid N150,000 apart from the monthly credit limit of N140,000.

“Despite the deposit for roaming services, my line remained blocked while I was abroad in the United Kingdom. During this time, I was unable to contact or be contacted by any of my friends, relations or business associates. This caused considerable embarrassment and loss to me”, the plaintiff said in his statement.

According to the plaintiff, upon his return to Nigeria, he lodged a formal complaint and paid another N150,000 into his account, even though the downloaded statement showed that there was balance in the account.

However, a few days later, his line was again blocked and he complained to the defendant again, only to be told that it was because his SIM card had not been registered.

The reason the defendant gave, the plaintiff stated, was not tenable because the subscription form and agreement, which the plaintiff filled in since 2002 contained all necessary information and was still in existence.

According to the plaintiff, the unwarranted and repeated blocking of his line was a vexing and most traumatic experience, which caused considerable loss and embarrassment to him, while he was still compelled to conduct a SIM card registration on February 23, 2011 and was assured that the line would be unblocked within 24 hours.

But his SIM card remained blocked and he still could not make calls. No date has been fixed for the hearing of the matter.
