افتراضي Lagos Court: Stakeholders Brainstorm On Sentencing Guidelines

Stakeholders in the Lagos State judiciary are brainstorming on statutory-based Sentencing Guidelines being developed for use in the administration of criminal justice in the state.

Essentially, the Lagos State Law Reform Commission, saddled with the responsibility of initiating or receiving proposals for law reforms in order to bring them in consonance with the prevailing social and moral values of modern society, has produced a draft of the Sentencing Guidelines on which the Stakeholders are deliberating.

Experts who are deliberating on the proposed Guidelines include Prof. A.A Adeyemi and Prof. Ayo Artsenuwa of the Faculty of Law, University of Lagos, Chairman of the Lagos State Law Reform Commission Mr. Olasupo Shasore, Justice Olubunmi Oyewole, representative of the Police, O.C in Charge of Panti, Mr. C. Agwu, Director of Public Prosecution, Ministry of Justice, Mrs. Bisi Ogungbesan, Magistrate Ani Niki Tobi and the Chief Judge of Lagos State, Justice Ayo Philips who was represented by an official.

At the opening session of the event which was held at the Old Secretariat, Ikeja, each discussant presented a review of the draft which consists of seven parts: Objectives, scope and nature of guidelines; purpose and overarching principles of sentencing; punishment generally; procedure and evidence; review of evidence relevant to sentencing; threshold tests; and miscellaneous.

In turn, the discussants took incisive look at the draft, and based on their practical experiences, identified what could constitute challenges in the implementation of the document. They expressed other concerns in some areas and stressed the need to improve on some sections and how to go about the improvement to make the objectives of the initiative easily realisable.

Lauding the initiative to codify the Sentencing guidelines, Ogungbesan noted that because the laws of the society are being subjected to review at different times, it is imperative to reform the Sentencing guidelines.

Magistrate Tobi canvassed a section that will make it binding on judges not to deviate from the Sentencing guidelines, except under certain circumstances.

To Prof. Artsenuwa, there is need to be scientific in approach to Sentencing because of the constant changes in the society. Besides, she noted that the Guidelines will check the tendencies of the judges to be bias in exercising their Sentencing power.

Prof. Adeyemi, who was the chairman of the event, also stressed the need to make the Guidelines binding on the judges, noting that the judiciary is among the conservative environments and judges are the most conservative as they are not always ready to do things in new ways. He lauded the initiative which, he said, will lay a solid foundation for legislative framework for Sentencing in the courts.
